2012
Personhood Colorado is currently in the process of getting the language approved by the Secretary of State and Attorney General. Planned Parenthood has sued to stop the approval process.
The following language is proposed:
Section 32. The right to life.
(1) Purpose. In order to affirm basic human dignity, be it resolved that the
right to
life in this constitution applies equally to all innocent persons.
(2) Effect. The intentional
killing of any innocent person is prohibited.
(a) Only birth control that kills a person shall be affected by this section.
(b) Only in vitro fertilization and assisted reproduction that kills a person
shall be affected by this section.
(c) Medical treatment for life threatening physical conditions intended to
preserve life shall not be affected by this section.
(d) Spontaneous miscarriages shall not be affected by this section.
(e) No innocent child created through rape or incest shall be killed for the
crime of his or her father.
(3) Definitions.
As used in this section,
(a) “Person” applies to every human being regardless of the method of creation.
(b) A “human being” is a member of the species homo
sapiens at any stage of development.
(c) “Spontaneous miscarriage” is the unintentional termination of a pregnancy.
(d) “Child” includes a human being prior to and during birth.
(e)“Medical treatment for life threatening physical
conditions intended to preserve life” includes but is not limited to treatment
for cancer, ectopic and molar pregnancy, twin-to-twin transfusion syndrome, and
placenta previa.
(4) Self-executing, and severability provision. All provisions of this section are self-executing and are severable.
2010
Personhood Colorado, led by Gualberto Garcia Jones, turned in 95,884 valid signatures to get the following Constitutional Amendment (Amendment 62) on the 2010 ballot:
Section 32. Person defined. As used in sections 3, 6, and 25 of Article II of the state constitution, the term "person" shall apply to every human being from the beginning of the biological development of that human being.
The ballot initiative lost 70% to 30%.
2008
In 2008, Colorado For Equal Rights, led by Kristi Burton, turned in 103,000 valid signatures to get the following Constitutional Amendment (Amendment 48) on the 2008 ballot:
Section 31. Person defined. As used in sections 3, 6, and 25 of article II of the state constitution, the terms "person" or "persons" shall include any human being from the moment of fertilization.
The ballot initiative lost 73% to 27%.

Dear Colorado Lawmaker: Every year that goes by, over one million children in the womb are brutally murdered through abortion. The key to unraveling this tragedy is a simple one and it has been known since before Roe v. Wade. It is Personhood. During oral argument of Roe, Chief Justice Warren Burger explained to pro-abortion attorney Sarah Weddington that by declaring "by statute that a fetus is a person for all constitutional purposes” a state could outlaw abortion. By stripping personhood from the unborn, their right to life was revoked. By returning personhood to the weak and the powerless, we can restore their dignity and right to life as human beings. It really is that simple. African slaves were denied their personhood and were therefore treated as property, bought, sold, and bred as animals. Jews were not considered full persons, so their property could be confiscated and their people eliminated. When Spanish conquistadors colonized America, many wealthy landowners fought to convince the Spanish crown that non-Christian “indians” were not legal persons and could therefore be enslaved. Personhood is the key to all human rights. That is why at the heart of the Roe v. Wade opinion is the following heartless pronouncement, written by Justice Blackmun, “the word ‘person’ ... does not include the unborn.” Not once, since 1973, has the Supreme Court been challenged to reconsider Blackmun’s terrible words. With federal and judicial tyranny at its apex, we the undersigned request that our Colorado legislators stand up for life in a bold and principled way. We, the undersigned urge you to support a personhood measure that recognizes that the preborn child is a person with the unalienable right to life. We, the undersigned expect you to stand up for the values of the people of Colorado by no longer cowering to a federal and judicial tyranny that mandates the destruction of our morals, our families, and our posterity. We, the undersigned will hold you accountable for your action or inaction in bringing about and supporting a personhood measure, and we will vote accordingly.
